THE COMMON LAW
The term common law is one that you will red of repeatedly in your study of law.We can use the term common law in three different contexts.
As a systerm of law
The Australian systern of law , in common with most other countries originally colonised by the English, is a common law system. It is a systerm based upon the English systerm of law; a mixture of customary law, judge-made law and parliamentary law.
This distinguishes it from the legal asystems in other countries that have a different basis of law such as Islarmic Law,Civil Law and Roman Law.
So when we use the term common law in this context, we are talking about what type of legal system we have.
As a division of law
Lawyers sometimes talk about the rules of common law , or common law remedies or common law actions . When they do this , they are tlking about substantive areas of law and procedures that are different from other areas of substantive law and procedure such as equity, or company law, or administrative law.
